TERMS & CONDITIONS

1.0 Foreword 

1.1 Hope Boats incorporates the terms of the British Marine Federation (BMF) terms of business (latest edition), copies of which can be found here. Any inconsistencies between the BMF terms and those set out below (as amended by Hope Boats) the terms set out below shall prevail. 

2.0 Liability & Responsibility

2.1 All items and equipment will be stored at the owner's risk. 

Hope Boats requires you to provide an appropriate level of insurance cover for your boat/ equipment which warrants that your boat/ equipment stored with Hope Boats is fully insured against fire, theft, and accidental damages and also includes third party cover up to two million pounds. You must state that you have this level of insurance on the online storage form.

Customers are obliged to produce evidence of such insurance within seven days if requested. 

2.2 Hope Boats will not be responsible for any loss or damage caused by events or circumstances beyond our reasonable control (i.e. severe weather conditions).

2.3 Hope Boats will not be responsible for any damages caused by wildlife (i.e. damages caused by cats, rats or similar) but will make an effort to ensure rodents are kept away in the form of humane traps.

2.4 Hope Boats will not be responsible for any loss or damage caused by a third party (i.e. sub-contractor). 

2.5 Hope Boats, agents of Hope Boats, and sub-contractors cannot be held responsible for death or personal injury caused in the storage of your boat/ equipment with Hope Boats, in the transport of your boat/ equipment, work on your boat/ equipment, or your use of your boat/ equipment. 

2.6 The customer will be fully responsible for the boat and/ or equipment between the collection date and the delivery date (i.e. During the time of use).

The customer will be responsible for securing the boat to a mooring (if applicable).

The customer will be responsible for ensuring the boat is above the high tide mark when not in use (if applicable).

The customer will be responsible for relocating the boat and/ or equipment in the event of severe weather.

Hope Boats are able to supply launch and recovery in the event of severe weather. A standard call-out charge will apply. Subject to availability. 

3.0 Payment, Prices and Estimates

3.1 Hope Boats will exercise reasonable skill and judgment to provide a quote. However, such quotes are always subject to the accuracy of information provided by the customer (using the online ‘Storage Form’).

3.2 Hope Boats will inform the customer promptly of any proposed increase in quoted prices and the reasons for it. Hope Boats will only proceed with the storage, maintenance, or logistics with the approval of the customer.

3.3 Storage fees are to be paid annually and storage invoices will be sent out on 1st August annually.

In both instances, an invoice will be issued detailing the payment dates.

3.4 All maintenance fees must be paid using the following payment scheme:

100% upon completion of the work carried out.

Hope Boats will issue an invoice upon completion of the works carried out. 

3.5 All Logistical fees must be paid using the following payment scheme:

100% upon completion, unless otherwise specified on the customer’s account. In such instances; the logistical fees will be included in the storage fees.

Hope Boats will issue an invoice upon completion of the works carried out. 

3.6 All payments must be completed no later than 28 days of the issue of an invoice.

4.0 Storage & Logistics

4.1 For health and safety and security reasons, customers are strictly prohibited to enter Hope Boats’ storage area. Trespassing is a criminal offence. 

4.2 Your boat and/ or equipment will be stored from your specified collection date to your specified delivery date. This information will be provided by you via the online ‘Storage Form’. Any amendments to the collection and/ or delivery date must be provided in writing via email within good time. 

4.3 Your boat and/ or equipment will be collected on the specified date from the specified location provided from the online ‘Storage Form’. 

The customer is responsible for the handover of any valuable items (i.e. keys). 

The boat and/ or equipment remains the responsibility of the customer until the handover is complete.

4.4 Your boat and/ or equipment will be delivered on the specified date to the specified location provided in the online ‘Storage Form’. 

The customer is responsible for the handover of any valuable items (i.e. keys). 

The boat and/ or equipment remains the responsibility of the customer after the handover is complete.

If the customer is not in attendance at the specified date/ time/ location of the handover; the boat and/ or equipment will be left in an appropriate position and the customer will be responsible for the collection of the keys from the Hope Boats’ representative’s location.

4.4 Non-compulsory safety equipment such as wheel clamps, hitch locks, trackers, etc. will be applied by Hope Boats once safely in the storage area. You (the customer) must ensure keys and/ or instructions are handed over to a Hope Boats representative on the specified collection date.

4.5 All keys will be handed over to a Hope Boats representative on the date of collection and will be handed back to you on the date of delivery. 

4.6 For health and safety and fire risk, all fuel must be removed from the boat and/ or equipment prior to the collection date.

All fuel will be either be:

  1. Removed by the customer prior to the collection date.

  2. Removed by Hope boats on the collection date. This is non-refundable and non-returnable. 

You hereby authorise Hope Boats to remove any fuel on the collection date. 

4.7 For health and safety and fire risk, all 12v batteries must will be removed from boats during the winter storage period

4.8 Any applicable harbour fees must be paid by the customer prior to the delivery date. Hope Boats is not responsible for any harbour fees in any instance. If the boat is refused by a Harbour Authority due to the non-payment of harbour fees by the customer, the customer is liable for any additional logistics fees incurred. 

Hope Cove harbour fees will be charged at the standard rate by the Harbour Master. 

Salcombe Harbour fees will be charged at the standard rate by SHDC. 

4.9 The customer is responsible for any arrangements and fees associated with trailer storage. 

Hope Boats can provide trailer storage (Charges apply)

Hope Cove trailer storage is included in your harbour fees, provided adequate space is available on the Harbour Beach. The customer must ensure the trailer is stored appropriately on the beach and is responsible for their trailer from the delivery date to the collection date.

Salcombe trailer storage is available from SHDC. Standard charges apply at the standard rate by SHDC. The customer will arrange this independently.

5.0 Boat Movements

5.1 If a customer has specified the boat is situated on a roadworthy trailer (in the online ‘Storage Form’) it must be in full working order and must comply with the National Trailer & Towing Association (NTTA) Regulations. 

If in the opinion of Hope Boats, the trailer is not roadworthy, Hope Boats are entitled to carry out necessary works to satisfy these regulations and the customer will be responsible for the cost of such works (including labour). 

You hereby authorise Hope Boats to carry out such works and adhere to the applicable payment charges. 

5.2 Hope Boats reserves the right to move boats and/ or equipment at any time for reasons of health and safety, security or good management of our business and premises.

6.0 Notices

6.1 Hope Boats require a minimum of 48 hours notice to remove your boat and/ or equipment to or from the storage area. You must inform Hope Boats in writing. An emergency call out rate is chargeable in all instances. 

7.0 Resolution Scheme

7.1 Title to all boats and/ or, equipment shall remain with Hope Boats until full payment has been received by us. If this exceeds the storage time period; Additional storage charges apply. 

7.2 Should an invoice remain unpaid for a period of greater than six months (of the original invoice date), Hope Boats reserves the right to sell boats and or equipment to recuperate debt. Prior notice will be given to the customer from Hope Boats.
